Usually for my commercial and free patches I start from a blank init patch,and it's more funny btw. To learn new synth I'm starting from a preset patch untill I can manage everything. So all my patches (both commercial and free) are designed totally from scratch

There isn't anyway to patent a synthetically generated sound ... samples , sure . Allot of sound designers have a stable of sounds that they actually specialize in ( genre specific ) ..; the late great Tim Conrade was known for spacey sounds and pads .. Designers can feel pretty secure in that the average Joe six pack isn't going to want to get into trying to reverse engineer their sounds ; ...It's allot of work and most will just pony up a twenty to get them ... If you are serious about becoming a sound design stud you should google up books by Simon Cann and look into a video that Rob Papen is supposed to be getting close to finishing. Allot if it is having a sound in your minds eye ( or ear !) and knowing which oscillator waveform would be best to start with , etc etc .... Obviously it's nice to know enough about it to shape sounds that are close to what you are after ..

regardless of how you do it, the little a$$holes on the torrent sites will have it available as a "free" download minutes after you release it. A fact of life....
There was a discussion about this not so long ago on kvr. Basically it is up to the plugins developers to implement this (simple) mechanism: - every preset stores the name of its original designer - the only way to clear the designer name and replace it with yours is to start with a blank preset That way, any preset made by tweaking the parameters of somebody else's will still display the original author's name.
Maybe the plugin could detect that enough changes have been made to the original preset, that it can be considered a brand new one - then it would clear the original owner name.
Nah, not so much - say a preset has 100 parameters, it would be considered new if more than 40 parameters have been changed, with an average variation of more than 10%.. something around those lines...
Sounds like you know your stuff ;) I think that sounds pretty nice for a start! I've started with 3rd party presets before, and then wound up with a TWISTED sound that in NO way sounded like how it started lol - and I'm just now getting into the true field of sound design. I love it. I'm working with my live recording rig, recording sounds out in the field, then Alchemy-ing them. One of my favorite things to do :) I currently live by Zebra, Absynth, Massive, Predator, and Rapture. I would like to get Rhino soon - looks tight! Ben
